In the wake of ransomware threats, the recent U.S. Supreme Court decision in Van Buren v. United States that gutted an employer's ability to bring suit against an employee for improper access to employer records, and the recently issued U.S. Department of Labor’s cybersecurity guidance for protecting ERISA-covered plan data from internal and external threats, employers have much to consider regarding protection of employee data as well as preventing employee misappropriation of company information.
