Bryan Scott is a seasoned litigator who has litigated cases in federal and state appellate courts, tried jury and bench trials, and handled arbitration and administrative hearings.
Bryan represents a wide range of clients in the construction industry, including public and private owners, developers, contractors, lenders, and insurers. He provides practical advice to clients on projects involving commercial, public, and multifamily construction; schools; hospitals; bridges and roadways; site development; slope stabilization; pipelines; and wastewater systems, among others. His experience covers contracting, lending, and bidding matters; compliance and operational concerns; and resolving disputes through trial, arbitration, or other means. These disputes often involve mechanics' liens and payment issues, cost impact and delay claims, defective design claims, insurance coverage, licensing, and related matters. He has represented licensees in disciplinary proceedings before the North Carolina General Contractor Licensing Board, the Private Protective Services Board, and the Commissioner of Insurance.
Bryan also handles commercial litigation and creditors' rights matters covering a range of areas, including contract disputes, collections and foreclosures, lender liability, title issues, insurance coverage, warranty claims, secured transactions, patent and trademark infringement, unfair trade practices and competition, shareholder disputes, fiduciary claims, and products liability. He has represented numerous community, super-regional, and national banks and credit unions in litigation and foreclosure proceedings related to distressed commercial loans involving both commercial and residential properties.
Bryan has extensive experience representing insurers and insureds in complex insurance coverage and bad-faith litigation, including matters arising from commercial general liability, errors and omissions, automobile, and workers' compensation policies.
