Tom Hooper helps clients navigate complex disputes in state and federal trial and appellate courts. His clients include businesses and individuals, and his practice spans a broad range of matters, including business, insurance, and financial services litigation. He has extensive experience handling cases involving contract, tort, and state and federal statutory claims.

Tom has represented clients in jury trials and appeals before the U.S. Court of Appeals for the Fourth Circuit, the North Carolina Supreme Court, and the North Carolina Court of Appeals. He has frequently appeared on behalf of clients in the North Carolina Business Court and in arbitration proceedings.

  • Defended a financial institution in the first case in which the U.S. Court of Appeals for the Fourth Circuit squarely addressed the Fair Credit Reporting Act (FCRA) preemption of state-law claims.

  • Defended an entrepreneur in the first North Carolina Supreme Court case in more than 30 years to consider the requirements for the formation of a general partnership.

  • Represented a private energy supplier in a putative multi-state class action.

  • Represented insurers in insurance coverage disputes related to liability, property, and life insurance policies.

  • Represented lenders in lender-liability lawsuits, commercial and consumer non-judicial foreclosure proceedings, and multi-million-dollar actions to recover on secured and unsecured commercial notes and guaranties.

  • Represented landlords in commercial landlord-tenant disputes.

  • Represented partners and joint venturers in partnership and venture litigation and arbitration.

  • Represented businesses in merger-and-acquisition-related litigation and arbitration.

  • Represented a national department store chain, transportation logistics company, and a furniture retailer in various franchisor-franchisee lawsuits and arbitration proceedings.
