Mr. Corbitt has significant experience with the laws, regulations, and administrative procedures governing eligibility for federal disaster and mitigation assistance. He regularly advises state and local governments, non-profit utilities, and other non-profit entities on compliance with federal grant requirements, with a particular focus on the Federal Emergency Management Agency's (FEMA) Public Assistance and Hazard Mitigation Assistance programs.

Mr. Corbitt assists clients throughout the full lifecycle of federally funded disaster recovery projects, including pre disaster compliance planning, emergency work substantiation, procurement and contracting for long-term recovery efforts, cost and work eligibility, documentation, audit readiness, and administrative appeals and arbitrations before the Civilian Board of Contract Appeals (CBCA).

FEMA Public Assistance Program – Dispute Resolution

Mr. Corbitt has represented numerous clients in first- and second-level FEMA appeals and in arbitration proceedings before the CBCA. In response to an adverse FEMA determination, applicants are entitled to first and second appeals to challenge FEMA's decision. Mr. Corbitt has drafted more than 50 first and second appeals on behalf of clients nationwide to ensure clients are able to maximize federal reimbursement consistent with FEMA guidance.

Congress amended the Stafford Act in 2018 to establish a separate arbitration process in lieu of a second appeal for events declared on or after January 1, 2016. Mr. Corbitt has participated in more than 20 arbitration proceedings, including drafting briefs, preparing witness testimony, cross-examining FEMA fact and expert witnesses, and presenting oral argument. Mr. Corbitt's experience in administrative appeals and arbitrations ensure clients are well-positioned to respond to adverse FEMA determinations.

  • Reviewed emergency purchase orders, requests for proposals, contracts, procurement policies, and written standards of conduct for compliance with FEMA procurement regulations for a large city in Texas.

  • Provided local government entity with around-the-clock procurement-compliance advice for various solicitations, contracts, and purchase orders, consisting of both competitive and non-competitive procurements.

  • Prepared procurement-compliance checklists and memoranda for various government entities to facilitate compliance with FEMA procurement regulations in advance of a disaster that requires work eligible for Federal Public Assistance funding.

  • Formulated and presented compliance presentation for large state-owned electrical power authority, focusing on non-competitive procurements and detailed solicitations.

  • Reviewed and analyzed national contractor construction agreements in order to ensure compliance with Texas law for eligible work performed under FEMA.

  • Briefed Second Appeal regarding de-obligation of more than $2 million based on reasonableness of equipment cost for large metropolitan government entity.

  • Briefed responsive documents to Award of Special Commissioner in eminent domain proceeding involving the acquisition of land for large pipeline client.

  • Briefed successful Application for Writ of Possession for client in high-profile condemnation suit, securing for client possession and access to property.

  • Assisted in drafting successful traditional motion for summary judgment for client in complex condemnation proceeding, securing for the client a judgment in its favor on the right to take.

  • Negotiated numerous settlements, ranging in value of approximately $40,0000 to $120,000, for breach of contract and Texas Insurance Code claims against client.

  • Briefed successful Default Judgment motion in favor of client, securing approximately $120,000 judgment for client.

  • Briefed successful traditional and no-evidence motion for summary judgment in favor of client against claims of negligence, breach of contract and unfair insurance claims. Both motions were granted and the case was disposed of in its entirety.

  • Briefed successful Request for Reconsideration for client who had been denied Medicare privileges by the Centers for Medicare and Medicaid Services, securing full reinstatement of client's Medicare privileges.

  • Briefed successful Motion to Strike Motion to Show Authority filed by opposing counsel alleging client did not have authority to appoint representation on its own behalf.

  • Briefed multiple position statements for labor and employment clients, defending clients against claims of unfair employment practices and breaches of federal and state employment laws.

  • Negotiated settlement for client regarding ownership and possession of federally-subsidized housing unit in Plano, Texas, resulting in payout agreement and writ of possession.

  • Drafted adopted consent resolutions for a Texas limited liability company, allowing the company to effectively comply with Texas rules and regulations, shielding company and its members from liability.

  • Drafted comprehensive lease agreement for commercial client, securing favorable terms for client and shielding client from liability.

  • Provided briefing to pro bono landowner clients regarding federal condemnation law, enabling landowners to effectively contest federal government condemnation claims for the building of a border fence across the United States – Mexico border.
