Helbert A. Canales-Rojas is a skilled litigator who concentrates his practice in the areas of financial services litigation, complex commercial litigation and real estate litigation.

Professional Biography

Mr. Canales-Rojas is a member of the Financial Services and Litigation Compliance Group, where he maintains a diverse litigation practice. Mr. Canales-Rojas represents clients on a wide variety of litigation matters, including financial services litigation, commercial litigation, real estate litigation and various other complex litigation matters in federal, state and appellate courts.

He has served as the co-lead attorney for more than 100 litigation matters pertaining to commercial litigation, real estate litigation, general liability defense, products liability defense, first-party property defense, and other complex litigation matters. While Mr. Canales-Rojas focuses his practice primarily on litigation matters, he also provides general counsel to business owners, general contractors, real estate developers, and real estate investors.

Mr. Canales-Rojas draws on his broad litigation and transactional experience to counsel clients by drafting and reviewing contracts, negotiating in the early stages of a dispute before proceeding to court, ensuring compliance with applicable industry laws and regulations, and implementing other preventative and cost-saving measures to proactively avoid lawsuits and other potentially costly liabilities.

Mr. Canales-Rojas earned his Juris Doctor degree from Florida International University College of Law, where he was a Dean’s Scholarship recipient and a research assistant to Judge Phyllis Kotey. Prior to law school, Mr. Canales-Rojas worked as a judicial intern to Judge James Lawrence King of the U.S. District Court for the Southern District of Florida.

Mr. Canales-Rojas is bilingual (English and Spanish) and has a working knowledge of Italian.

  • Prevailed at hearing on motion for sanctions and secured entitlement to attorney's fees against Plaintiff and Plaintiff's attorneys for filing meritless commercial eviction lawsuit.

  • Prevailed at hearings on motions to strike affirmative defenses and motions to compel discovery in various commercial litigation matters.

  • Obtained a final summary judgment for a property insurance carrier, finding that the claimant's damages, which were comprised of an unsolicited engineering report, were not covered under the insurance policy.

  • Awarded a final summary judgment in the North District of Florida on the insureds' claim that their beachfront property suffered a collapse, which was not supported by the undisputed evidence and specific policy language provided for collapse coverage.
