Kimberly Lopez

Drawing on her deep litigation experience, Kimberly represents financial institutions in a wide range of matters, including commercial disputes, class actions, and fiduciary claims. She also advises banks and lenders on the enforcement of creditors' rights and is well-versed in Florida collection law, frequently assisting clients with judgment enforcement. Kimberly has successfully prosecuted claims and recovered assets arising from multimillion‑dollar defaulted debts. She takes a business‑first approach to litigation, recognizing that disputes can divert financial institutions from their core objectives. She partners closely with national credit unions, regional and midsize banks, and asset managers to simplify complex challenges and develop practical litigation strategies that support commercial goals. Her focus is delivering strong results while protecting operations, reputation, and the bottom line.

Kimberly regularly defends clients against statutory and regulatory claims arising under the Telephone Consumer Protection Act (TCPA), Florida Consumer Collection Practices Act (FCCPA), Real Estate Settlement Procedures Act (RESPA), Fair Credit Reporting Act (FCRA), Equal Credit Opportunity Act (ECOA), and Fair Debt Collection Practices Act (FDCPA). She also has substantial experience negotiating sales agreements and contract negotiations and resolving disputes among co‑owners of closely held companies and limited liability company members. Additionally, Kimberly litigates deceptive business practices, fraud, business torts, and contract claims.

Kimberly is an award-winning diversity, equity, and inclusion (DEI) advocate and leader. She is the creator and founder of Latina Legal Minds, a platform and podcast dedicated to empowering Latina attorneys, amplifying their voices, and fostering community.

Prior to entering private practice, Kimberly served as an extern with the U.S. Attorney's Office in Orlando, Florida.

• Represented large financial institutions in numerous TCPA actions, avoiding class certification through efficient and strategic litigation.

• Obtained summary judgment in favor of a financial institution and an award of costs in FCRA litigation on a novel issue of law.

• Advised a global asset management company in the collection and workout of a loan transaction exceeding $35 million.

• Represented a financial institution in enforcing multimillion‑dollar loan obligations against foreign investors arising from distressed real estate transactions, including the recognition and enforcement of judgments in foreign jurisdictions.

• Represented a commercial lender in numerous multimillion‑dollar commercial foreclosures, receiverships, and loan workouts, including the enforcement and collection of a broad range of collateral, such as office buildings, restaurants, medical equipment, and accounts receivable.

• Obtained the dismissal of a plaintiff's $1 million ECOA claim, which was upheld by the Eleventh Circuit.

• Represented a financial institution enforcing loan documents against foreign investors on loans in excess of $1 million in connection with distressed real estate and enforcement of those judgments abroad.

• Represented a large cigar manufacturer in defending $70 million in antitrust and related tort and contract claims in the Central District of California.

• Defended a government prime contractor in federal court litigation brought by a subcontractor seeking damages in excess of $9 million.

• Defended an international coffee company in a supplier dispute involving the termination of a long‑term contract in the Western District of Wisconsin.

• Represented a home builder in recovering all attorneys' fees and costs based on opposing party misconduct and successfully defended the trial court's order on appeal.

• Represented a Fortune 500 company against trademark infringement and unfair and deceptive trade practices claims.
