This program will cover the general areas of concern when a governmental entity seeks to acquire a privately-owned water utility through the power of eminent domain. We will examine the pre-litigation, right-to-take, and valuation phases of this type of action with an emphasis on the differences in procedural requirements and challenges in different states.
