Overview

The Consumer Financial Protection Bureau (CFPB) was created by the Dodd-Frank Act and has authority to examine and enforce consumer protection laws, and to issue regulations implementing new consumer protection laws. Together, Baker Donelson's financial services attorneys have the knowledge and broad range of experience clients need to stay up to date with the CFPB.

Regulatory Compliance

Baker Donelson attorneys regularly counsel clients on various financial regulatory issues, including compliance and enforcement actions like those brought by the CFPB. All of our attorneys routinely respond to inquiries from the CFPB and other governmental agencies. However, our experience is even broader as many of our team members have experience in resolving CFPB and other issues while working in-house at various financial institutions. Prior to joining Baker Donelson, one member of our team managed and coordinated a team of in-house senior legal officers and attorneys at a large national bank in responding to and resolving consumer lending issues presented by State Attorneys General, HUD, CFPB, OCC, State Banking Departments and Congressional inquiries. He also led the implementation and management process for that bank's Executive Office's compliance with the National Mortgage Settlement, as well as changes to various internal processes to comply with the Dodd-Frank Act. Another team member previously worked as a banker for one national bank, and worked in the credit, collections, fraud operations, and consumer loan departments of another national bank. These experiences help us view our client's issues both from a legal and business perspective.

Litigation and Enforcement

Our trial lawyers represent clients in state and federal court litigation involving a range of claims, such as lender liability, servicer liability, breach of fiduciary duties, loan recovery, consumer finance, and litigation based on the variety of regulations promulgated under Dodd-Frank. We have also handled bankruptcy cases and associated litigation for some of the largest mortgage servicing companies in the country, as well as other banks and financial institutions.

Resources

We have provided training for bank clients on CFPB issues and have a team dedicated to writing on the CFPB and other financial regulatory topics. This in-depth knowledge and experience, along with our regular webinar presentations, keeps Baker Donelson attorneys up to date and informed on the latest developments in this quickly-changing area of the law. We also issue CFPB Focus, a newsletter designed to keep clients informed on the latest rules and issues arising out of the CFPB.
