Please join Baker Donelson attorneys at the NACUA Title IX workshop Sexual Misconduct on Campus: Prevention, Compliance, Response and Beyond, on January 22–23, 2016, in Nashville. This workshop will address a wide range of issues related to sexual misconduct on campus, with sessions ranging from issues of prevention and compliance to those of response and external proceedings.

Dan Cohen will be on a panel on Saturday, January 23, at 9:30 a.m. titled I Fought Authority and Authority Always Wins – Strategies for Pushing Back on OCR. The session will cover:

  • Inconsistencies in Office for Civil Rights (OCR) positions – how to push back during the resolution process.
  • Instances where OCR doesn't follow its case processing manual – how to draw attention to the manual changes and to OCR discrepancies.
  • Limits of OCR's enforcement authority.
  • Reconciling OCR's guidance with constitutional due process requirements.
  • Reconciling OCR's enforcement scheme with the Supreme Court's Gebser standard of deliberate indifference for institutional liability.
