The U.S. Supreme Court's 2016 decision in Spokeo, Inc. v. Robins strengthened defendants' efforts to secure dismissal of federal statutory actions based on lack of standing to sue. This has been particularly effective in the context of the Fair and Accurate Credit Transactions Act (FACTA), and defendants are also having success challenging standing in other statutory contexts, including FDCPA and FRCA cases. We'll discuss FACTA, but also in this webinar, we will review when and how standing defenses have been successful, discuss some of the pitfalls, and talk about how financial institutions and other businesses can mitigate risks.
