New Deadline in Effect to Claim Tax Sale Excess Proceeds in Florida

As we announced in our March 15, 2018 alert, a new deadline to claim excess proceeds generated by tax sales goes into effect November 1, 2018. Mortgage holders of record seeking to claim excess proceeds from tax sales in Florida must file their claim no later than 120 days from the date of the clerk's notice of the excess proceeds. This is a hard deadline imposed by revised Fla. Stat. Sect. 197.582(3). Any party making a claim to the excess funds after 120 days from the date of the notice will be absolutely barred.
