Employment lawsuits are costly and time-consuming for employers. A federal court lawsuit often includes an EEOC Charge and response, followed by an extensive discovery period and motion practice prior to a trial. State court lawsuits typically do not have the same rigorous scheduling deadlines as federal cases and can drag on indefinitely if not handled with care. As most employers know, however, it makes good business sense to litigate some cases all the way through trial.
