In recent years there has been a steady increase in the number of claims involving the Fair Labor Standards Act, the Equal Pay Act and state wage and hour laws. Even more troubling is the upsurge of class (collection) action lawsuits by plaintiffs' lawyers who have turned to wage and hour lawsuits as their new area of opportunity to leverage multimillion-dollar settlements and huge attorney fee awards.

While the Trump Department of Labor is not as aggressive in enforcement as the former DOL, there are still proposed changes at the agency level challenging long-standing positions concerning exemptions from overtime and compensable hours of work. Learn about the current trends in wage and hour litigation and, more importantly, about the areas we see as the trends for 2019 and beyond.

This presentation will provide employers with valuable advice on how to evaluate your risk of exposure under the FLSA, learn what you can do to avoid FLSA claims, and how to position yourself to defeat attempts to target your business for class and collective action lawsuits. Among the topics we will cover are:

  • DOL New Overtime Rules
  • The Ins & Outs of Litigating Collective Actions
  • DOL PAID Program
  • Pay Equity
  • Recent DOL Wage & Hour Opinions (including departure from historical position on tip credits)
  • Joint Federal and State Worker Misclassification Initiative (Independent Contractors)
  • State Wage and Hour Litigation Trends
