Clint Crosby concentrates his practice in intellectual property and business litigation. He also assists clients with technology transactions and matters relating to cybersecurity and data breach events. For many of Mr. Crosby's clients he acts as their external general counsel and assists with their comprehensive business and legal needs.

Professional Biography


Mr. Crosby's intellectual property litigation experience includes matters relating to patents, trademarks, copyrights, trade secrets and unfair competition. He handles cases for both individuals and corporations, including declaratory judgment and infringement actions. Mr. Crosby also counsels clients regarding their intellectual property and how best to preserve, protect and maximize intellectual property assets. Mr. Crosby also guides clients, including social media providers, on the use of copyrighted materials and images, and compliance with the Digital Millennium Copyright Act.

His technology matters include counseling and litigation regarding technology purchases, licensing and disputes regarding ownership and theft of company assets including software and data. Mr. Crosby also addresses cybersecurity needs for his clients including data security planning and responding to cyber threats including data breaches, ransomware and DDoS attacks. He co-founded Baker Donelson's Cybersecurity Accelerator (2015 – 2018) and Cybercon Cybersecurity Conference (2015 – 2019). 

Mr. Crosby acts as a counselor and external general counsel for ongoing businesses and growth-oriented companies, assisting them with formation, operating agreements, employment strategies, intellectual property issues and litigation management.

He practices extensively in federal and state courts throughout the country and is also licensed to practice before the U.S. Patent and Trademark Office.

  • Intellectual Property

  • Co-lead counsel for a patent owner in its enforcement campaign resulting in the filing of more than 25 lawsuits throughout the U.S.

  • Lead counsel for a national gaming company for their patent prosecution and patent enforcement efforts.

  • Represented a large ceiling fan manufacturer in patent infringement matters throughout the U.S.

  • Handled trademark and copyright infringement claims for a nationally-known real estate educator.

  • Advised builders on copyright issues relating to architectural plans, defended and prosecuted copyright infringement claims relating to architectural plans.

  • Litigated patent infringement matters for manufacturers of laser bore sights and bulk-bag liners.

  • Defended restaurant against trademark infringement claims including instituting cancellation proceedings at the Trademark Trial and Appeal Board.

  • Successful representation of clients in inter partes review matters before the Patent Trial and Appeal Board.

  • Represented a real estate asset management company in a trademark infringement lawsuit against another asset management company. Achieved a favorable settlement.

  • Business Litigation

  • Defended a nationwide retailer in water and sediment runoff litigation arising from a commercial real estate development.

  • Defended a public university research foundation against a qui tam action alleging fraud in the procurement of research grants.

  • Represented a national logistics company on breach of contract and non-compete matters.

  • Defended a banking corporation against class-action allegations of securities fraud and breach of fiduciary duties.

  • Represented a real estate developer against fraud claims arising from the execution of a multimillion dollar promissory note resulting in a favorable settlement.

  • Obtained a defense verdict for a mortgage lending corporation in a case in which the plaintiff alleged that the defendant provided a reverse mortgage to a borrower who did not have sufficient capacity and/or was not provided with required disclosures. After a two-day trial the jury ruled in favor of the lender in less than two hours.

  • Successfully defended a communications company in a $2.5 million lawsuit in Georgia state court against claims for nuisance and trespass due to the presence of the company's fiber optic lines.

  • Assisted a client with pursuit of DDoS attacker to include engaging federal prosecution.
