Mr. Harvey is also experienced with defending individual and corporate insureds in matters of third-party liability. He has more than ten years of experience representing clients in a variety of disputes and has tried numerous cases throughout Florida.

His practice focuses on assisting financial services clients achieve successful resolution in disputes related to commercial and residential loan defaults, debt collection practices under state and federal law, lien priority, and challenges to residential mortgage loan origination. He regularly handles all aspects of litigation, from pre‐suit to post‐judgment, and assists clients with legal strategy for short-term issues and long-term policies. He has also served as a client liaison to ensure that strategic goals are met, while also advising clients of legal issues that are trending.

  • Obtained numerous settlements in favor of senior leinholder with junior leinholder(s) disputing priority of secured liens.

  • Awarded multiple judgments after bench trials with significant evidentiary hurdles through reconstruction of records from multiple sources spanning several decades.

  • Obtained judgment after successfully arguing the right of court to invoke judicial estoppel against bad-faith litigant despite avoidance not being preserved by prior counsel.

  • Obtained judgment after successfully arguing negotiability of a loan product with a varying principle based on capitalization of deferred interest.

  • Represented a major bank in a lawsuit seeking recovery of a defaulted commercial loan and negotiated a favorable settlement.
