Professional Biography

Ms. Nelson has significant experience in health care liability defense, commercial litigation, insurance coverage litigation, and insurance defense. Ms. Nelson's practice also focuses on counseling and litigation on behalf of employer clients in the area of labor and employment.

As a member of the Health Care Litigation Group, Ms. Nelson represents health care providers, including physicians, medical practice groups, and medical institutions in defending all phases of lawsuits alleging health care liability in federal and state courts.

In addition to representing health care providers, Ms. Nelson is experienced in representing employers in labor and employment matters pending before the EEOC and in federal court. Ms. Nelson also represents business clients in commercial litigation and handles diverse matters arising in the insurance defense context.

Ms. Nelson has counseled and represented insurance carriers in insurance coverage litigation involving long-tail exposure, including asbestos and environmental claims. She has also litigated and arbitrated property/casualty reinsurance disputes. Ms. Nelson has experience representing and counseling a federally funded captive insurer concerning matters relating to World Trade Center debris removal liability claims.

  • Obtained defense verdict on behalf of urologist after jury trial in a case alleging lack of informed consent and medical battery after a bladder resection procedure.

  • Obtained summary judgment on behalf of physician in lawsuit alleging medical negligence based on expiration of the statute of limitations and failure to provide pre-suit notice in compliance with Tennessee's Health Care Liability Act.

  • Counseled employer clients and litigated matters involving alleged violations of the ADA and FMLA.

  • Counseled and represented insurance carriers in coverage litigation over asbestos, environmental, and other long-term exposure claims.

  • Assisted in the successful negotiation of insurance coverage disputes involving multiple insurance carriers with primary and excess coverage.

  • Represented a federally funded captive insurance company, created to respond to litigation arising out of the 9/11 terrorist attack in New York City, in a variety of matters relating to claims-handling advice, regulatory requirements, and insurance-coverage litigation.
