Ms. Carter represents a broad spectrum of health care providers, including hospitals and health systems, clinical laboratories, physician group practices and other health care providers.
Ms. Carter focuses her practice on advising clients regarding federal and state fraud and abuse laws and regulatory compliance issues. She has extensive experience analyzing arrangements under the federal Anti-Kickback Statute, Stark Law and state fraud and abuse provisions. She takes a holistic approach to advising clients about potential arrangements to help them focus on their business objectives while navigating through the myriad of regulatory laws facing health care providers and companies.
Ms. Carter routinely advises clients regarding:
- Evaluating potential physician contracting arrangements, joint ventures and other initiatives for compliance with the Anti-Kickback Statute, Stark Law, OIG civil monetary penalties law, and state fraud and abuse provisions.
- Working with clinical laboratories and other ancillary providers to evaluate testing programs and processes for compliance with federal fraud and abuse laws, CLIA, EKRA and state licensure and regulatory laws.
- Resolving unintended violations of the federal and state fraud and abuse laws through self-disclosure to CMS, OIG and other state and federal agencies.
- Conducting internal investigations, audits and compliance reviews.
- Defending health care organizations undergoing government investigations, inquiries and audits.
- Conducting health care regulatory due diligence to assist health care organizations through mergers and acquisitions.
- Developing, implementing and reviewing compliance programs and health care regulatory policies and procedures.
- Negotiating and implementing corporate integrity agreements, including successfully navigating operating under a CIA and conducting Focus Arrangement reviews.
Ms. Carter is active in the American Health Law Association. She currently serves as the vice chair for Educational Programming for the Fraud and Abuse Practice Group, and recently served as the vice chair of the Women's Leadership Council. Active in the community, she was selected for The Daily Record's Leading Women in 2011. She has also been named a Maryland Rising Star on a number of occasions by Maryland Super Lawyers in the area of Health Care Law.
Ms. Carter frequently lectures and drafts articles on fraud and abuse, and compliance issues.
Prior to joining Baker Donelson, Ms. Carter served the Honorable John Philip Miller (Circuit Court for Baltimore City); advocated for the University of Maryland School of Law's Health Care, Child Welfare, and AIDS Advocacy Clinic; and worked with the Maryland Veterans Caucus as part of the Maryland General Assembly.
