Gabriel Kotch assists companies with building and managing industry-leading global data privacy and security compliance programs.

Professional Biography


Gabe solves complex problems, especially those related to the collection, safeguarding and processing of data and personal information and the transfer of data domestically and internationally. He also provides privacy and regulatory compliance assistance throughout the contracting process, including compliance with domestic and international privacy laws.

Prior to joining Baker Donelson, Gabe served in various roles in the private sector and represented clients across various industries, including those in the hospitality, accounting, insurance, consulting and life sciences space. He also served as Chief Privacy Counsel for a large international hospitality company, where he was responsible for the creation and ongoing management of the company's global privacy program.

Gabe regularly counsels clients on data privacy and security regulatory compliance issues related to domestic privacy laws (such as the CCPA, data breach laws, and state and federal privacy laws) and global data privacy laws (including the GDPR, PIPEDA, ePrivacy Directive and other international privacy laws). He has significant experience in data privacy and security, including developing industry-leading data privacy and security programs, assisting management in identifying and mitigating privacy-related risks and managing data privacy and security-related investigations as well as with negotiating software-as-a-service and related technology agreements.

  • Counseled a Big 4 accounting firm in maturing its global privacy program and assisted with developing and negotiating technology-related contractual privacy terms.

  • Assisted a pharmaceutical company in the creation of a privacy program playbook and negotiation of Data Processing Agreements.

  • Conducted a comprehensive data privacy gap assessment for one of the largest private insurance and financial services companies in the U.S. and assisted the company in developing and maturing its data privacy program.

  • Led development and implementation of a global privacy program for a large international hospitality company.
