In our June Chat, we discussed various restraints on trade in the antitrust context – one of those being non-competition restrictions imposed by employers and the difficulties that arise regarding the rising trend at the state level restricting employers' rights. D.C.'s ban on non-competition provisions takes effect on October 1, 2022, and prior to recent amendments, was one of the most restrictive laws in the U.S.
During this month's Chat we will discuss the law's provisions and the recent amendments that are favorable to employers with workers in the District, but that also create certain notice obligations and other limitations not so favorable to employers.
