Overview

Ted is a proven problem solver. He has a unique combination of experience that includes 14 years in-house at Hilton Hotels Corporation managing material litigation, dispute resolution and franchise contracts. He has an equal number of years as outside counsel helping clients address complex legal matters.

Ted is business-oriented, cost-conscious, agile and entrepreneurial. He is also adept at building and sustaining relationships. He always seeks to provide proactive and innovative solutions for his clients. In addition to dispute resolution, he also actively litigates a range of cases in state and federal courts, including business and commercial disputes involving energy, distribution, employment, trade secrets and real estate matters. He also serves as outside general counsel to a number of small to mid-sized franchise based businesses assisting them with contractual drafting, negotiation and enforcement among other things.

Ted has been certified as a Rule 31 mediator since 2009. He is a member of the Tennessee Association of Professional Mediators (TAPM) and is listed on the approved mediator panel for the United States District Court for Eastern and Western Districts of Tennessee.

Ted values providing better results, efficient service and having trusted relationships with clients. He is open to alternative fee arrangements to meet each client's unique circumstance.

  • Represented an international paper company in its dispute with a glue vendor in conjunction with a substantial recall of defective boxes.
  • Assisted a multi-national plumbing manufacturer in resolving commercial disputes arising from three inter-related federal court actions.
  • Obtained summary judgment including an award of attorneys' fees in an indemnification dispute between a commercial landlord and tenant.
  • Negotiated a separation agreement from a major corporation on behalf of a senior executive, including the resolution of non-compete concerns, and negotiated the executive's new employment agreement with a different company.

  • Resolved a race discrimination claim asserted through a state human rights agency against a hotel management company.
  • Strategic support to a number of franchise-related business and emerging companies.
  • Listed as a Rule 31 mediator since 2009.
  • Represented the plaintiff in a case involving enforcement of non-compete and termination provisions in a franchise agreement.  Reached a confidential settlement for work out of termination issues and adjustments to the defendant's ongoing business.

  • Represented a motor fuels distributor in the United States District Court of the Eastern District of Tennessee regarding breach of exclusive supply agreement. Successfully achieved a confidential financial settlement for the client, along with a new ten-year exclusive supply agreement.

  • Successfully represented a petroleum corporation in a breach of two exclusive supply agreements, resulting in an award of liquidated damages and attorneys' fees, securing almost $1 million dollars.
  • Represented a motor fuels distributor in the United States District Court of the Western District of Tennessee regarding a breach of exclusive supply agreement. Secured a confidential financial settlement for the client prior to trial.
