Represented owner of M/V ANGELA BRILEY in extensive litigation arising from explosion aboard its vessel moored at major oil company production platform in Gulf of Mexico resulting in severe damage to vessel and ultimate death of captain wherein jury dismissed all claims against client vessel owner/Jones Act employer of deceased captain, while awarding nearly $14 million against co-defendant oil company and operator; in separate action recovered for owner’s hull damage.
Represented fishing fleet owner in several cases in state and federal court including reported case of White v. Empire Menhaden where judgments obtained denying seaman status to employees and dismissal of their claims.

Represented the Board of Commissioners of the Port of New Orleans in connection with Orange Street Wharf Fire which destroyed 1,000 feet of wharfage and valuable cargo stored on the Mississippi River in downtown New Orleans with favorable result for the Board.

Overview

For more than 30 years Mr. Clotworthy's practice has focused on maritime personal injury, energy, marine casualties and insurance coverage disputes. Mr. Clotworthy represents maritime employers in personal injury defense litigation in the areas of ocean and inland marine and energy and liability, with particular emphasis on onshore and offshore oilfield, river and port-related casualties.

This work has involved vessel owners, operators, commercial fishing fleets, casinos, bridges, dock and terminal owners, port authorities, and underwriters in connection with collisions and allisions, groundings and sinkings, pollution, property damage and fire-related casualties over the past 30 years in the Port of New Orleans, Gulf of Mexico and overseas.

Additionally, his representation has extended to general liability and marine underwriters in regard to coverage issues involving a broad range of marine, yacht, general liability, primary, excess and umbrella forms of coverage, including representing the interests of underwriters in litigation arising out of coverage disputes. Mr. Clotworthy has been awarded the "AV" rating by the Martindale-Hubbell Law Directory, which is the highest possible rating for legal ability and ethical standards.

  • Represented the Board of Commissioners of the Port of New Orleans in connection with the striking by a tug and collapse of its high rise Judge Seeber Bridge over the Industrial Canal in New Orleans with resulting deaths and injuries from automobiles plunging into the canal below wherein dismissals of the claims by way of summary judgment were obtained in Civil District Court in New Orleans.

  • Represented insurance broker in claim by its former assured seeking to hold broker liable to respond for lack of coverage for numerous claims due to the failure of London underwriters resulting in favorable landmark ruling for broker by Louisiana 4th Circuit Court of Appeal dismissing all claims.
  • Represented major international oilfield contractor at request of London insurance market in defense of claim for alleged improper loading and sinking of M/V SABLE wherein liability was avoided for sinking and recovery was made for lost equipment.
  • Defended a riverboat casino owner in a dram shop liability case filed in Texas federal court after an intoxicated casino patron, while driving on the wrong side of the interstate in Louisiana, struck a car from Texas, killing and severely injuring the occupants. Obtained a favorable settlement pursuant to Louisiana's dramshop liability law.
  • Represented riverboat casino owner in matter where obtained a favorable ruling from Louisiana Federal Court that riverboat was not a vessel, resulting in dismissal of serious personal injury claim.
  • Represented the underwriters of a vessel which sank in Dubai, and obtained settlement for less than the sum offered at the outset of litigation.
  • Represented a builder's risk underwriters in the loss of a mega-yacht.
  • Represented drilling company underwriters in the London market in connection with serious personal injury to rig workers.
  • Represented Union Pacific Railroad in connection with bridge allision resulting in loss of vessel, crane barge and injuries to crew, with no recovery by vessel interests and recovery of bridge damages.
