Mr. Whitaker's practice focuses on commercial real estate development and finance transactions in the transportation and seniors housing areas.

Mr. Whitaker's practice also includes the drafting of wills and trusts and the implementation of sophisticated estate planning strategies.

  • Represented regional long-term care provider with $9.3 million purchase of 152-bed skilled nursing facility and 340 unit assisted living facility.

  • Negotiated and closed the sale of a regional transportation terminal in Nebraska on behalf of a national transportation carrier.

  • Assisted a national care provider in selling its long-term leasehold interest in a 240-bed skilled nursing facility.

  • Assisted a regional real estate developer with developing and selling 24-unit, 35-unit and 48-unit mixed-use condominium developments.

  • Represented national transportation carrier with acquisition of leasehold interests in distribution centers located in Arizona, Georgia, Illinois, Michigan, New York, Ohio, Pennsylvania, Texas, Utah and Washington.

  • Negotiated and closed the re-financing of a $19 million loan secured by a 29,000 square foot office building and terminal situated on a 48-acre site in southern California.

  • Represented a national transportation carrier with $5.3 million refinance of indebtedness secured by terminals in Tennessee and Georgia.

  • Represented a national transportation carrier in purchase of undeveloped 38-acre tract of land followed by construction of 2,000 foot public road and state-of-the-art transportation terminal.

  • Represented a national transportation carrier in the re-finance of a $3.6 million loan secured by warehouse and transportation terminal.

  • Negotiated and closed drop yard leases in multiple locations, including California, Georgia, Illinois, Louisiana, Texas and Washington.

  • Represented a regional long-term care provider in negotiating and closing a $6.5 million loan for the construction of a 50-unit, 75-bed personal care home in the state of Georgia.

  • Represented a regional long-term care provider with $7.5 million lease-purchase of 180-bed skilled nursing facility and 70-unit residential care facility.

  • Represented an employee stock option plan in the $30 million acquisition of all outstanding shares of a trucking company with operations in 12 states. The transaction, which took six months to close, required extensive real estate, environmental, tax and contractual due diligence.
