Jennifer McNamara concentrates her practice in the areas of commercial litigation, employment, intellectual property, and media law.

Professional Biography


Ms. McNamara's commercial litigation experience includes representing corporate and individual clients in a variety of business disputes, including class actions, contract disputes, defamation claims, franchise disputes and unfair trade practice claims. Ms. McNamara's experience also involves numerous aspects of the oil and gas industry. She has litigated environmental issues, lease disputes and liens. Her experience also includes the successful defense of corporate and individual defendants in a $100 million lawsuit arising from the sale of oil and gas properties in south Louisiana.

Ms. McNamara's employment law experience includes defending employers against claims brought under state discrimination statutes, the Family Medical Leave Act, Title VII, the Age Discrimination in Employment Act and the Fair Labor Standards Act before the EEOC, in mediation, and in state and federal courts. Her employment litigation experience includes multi-plaintiff litigation and putative class actions. She also counsels employers regarding personnel policies, training programs and covenants not to compete.

With respect to her intellectual property practice, Ms. McNamara counsels clients on copyright, trademark, and defamation issues arising from internet publications and websites. She is experienced in handling trademark and copyright litigation, including litigation arising from the transfer and use of domain names and copyright claims in the area of software development.

Ms. McNamara also counsels and represents media clients in pre-publication and pre-broadcast review, defamation defense, privacy law, courtroom access, public records and open meetings, reporter’s privilege and other First Amendment issues. Ms. McNamara’s experience also includes having been engaged as an expert on First Amendment principles and defenses in defamation litigation brought in a foreign court.

Representative Matters
  • Served as lead counsel for many clients on employment-related litigation, including Title VII, FMLA, and ADA issues.

  • Served as outside counsel for numerous clients on handbook and policy compliance with existing and anticipated developments in employment law, including in heavily regulated industries.

  • Served as outside counsel for FLSA and other wage and hour audits for clients in regulated industries involving discrete exemptions.
