Overview

David Maron represents clients in commercial litigation with an emphasis in attorney general consumer protection, consumer fraud and related government regulatory actions. He has served as defense liaison counsel in multiple attorney general-led pharmaceutical price litigation cases. Among his other complex litigation matters, he has defended businesses in commercial, insurance, agricultural, toxic tort and product liability matters in difficult jurisdictions, including several rated as "Judicial Hellholes" by the American Tort Reform Association.

Mr. Maron has written and spoken on civil justice topics such as statutory caps on non-economic damages and related litigation reforms. He has also authored and co-authored amicus briefs on behalf of business clients in cases before the Mississippi Supreme Court in support of civil justice issues.

Mr. Maron has been active in the profession having served as president of the Capital Area Bar Association, Mississippi's largest volunteer bar association. He remains active in the state bar association and in various national and local bar association activities. He has also been recognized for his pro-bono service by the Mississippi Center for Justice, as well as by the Firm with its Firm-wide pro-bono award.

  • Defending national retail pharmacy chain in state attorney general litigation alleging violation of unfair trade practices acts, false claims and Medicaid fraud act.

  • Successfully represented biopharmaceutical company in a state Medicaid reimbursement dispute regarding scope of prior authorization and coverage of medicine therapy for rare genetic-based disease.

  • Defense of pharmaceutical manufacturers in false claims and enforcement actions brought by state Medicaid agency challenging reimbursement and alleging inaccurate reporting of price benchmarks.

  • Represented an international insurance company regarding a domestic subsidiary's contested regulatory and residual insurance market challenges under state and federal laws.

  • As court-appointed defense liaison counsel coordinated local joint defense discovery, motion practice and litigation strategies as in In re: Mississippi Medicaid Pharmaceutical Average Wholesale Price Litigation, an attorney general master action with more than 50 pharmaceutical manufacturer defendants.

  • Represented the Mississippi Insurance Department in a contested administrative litigation involving complex $1.6 billion corporate restructuring of Mississippi's largest property and casualty insurer under Mississippi insurance holding company act and change of control statutes.

  • Successfully defended a national construction aggregate company in silica toxic tort litigation achieving favorable dismissal of more than 200 multi-plaintiff cases through aggressive motion practice, strategic discovery both direct and third party and joint defense coordination with industry experts.

  • Represented cigarette manufacturers in state and federal court in Mississippi individual mass tort product liability litigation as well as attorney general litigation, coordinating joint defense discovery and motion practice.

  • Served as trial and co-appellate counsel for defendants in toxic tort industrial exposure successfully challenged improper joinder of plaintiffs in recognized "Judicial Hellhole" jurisdiction. 3M Co. et al. v. Glass, 917 So. 2d 90 (Miss. 2005).

  • Defended pharmaceutical manufacturer in favorably resolving a multimillion dollar dispute involving aseptic manufacturing of a biopharmaceutical product.
