Overview

Mr. Wilgenbusch counsels clients in a wide array of matters including real estate sales and purchases, lending, leasing, state and local incentives, and general corporate matters.

Mr. Wilgenbusch works with clients from the preliminary site selection and incentive negotiation phase of a project through the ultimate lending and development/construction process.  Mr. Wilgenbusch also represents hotels and retailers in securing on and off-premises beer and liquor permits from local and state level regulators.

Prior to joining Baker Donelson, Mr. Wilgenbusch worked with the Federal Deposit Insurance Corporation where he was exposed to and gained experience working on various banking regulatory matters.

  • Commercial Lending

  • Represented a Nashville-based bank on approximately $15 million in construction and term loans to finance self-storage facilities across the United States.

  • Advised a national bank on local issues related to a $33 million construction loan to renovate a downtown skyscraper.

  • Represented an industrial development board in a $3 million seller financed transaction to facilitate the construction of a solar-farm.

  • Counseled industrial development board on a $3.8 million loan secured by revenues generated through a tax increment finance award.

  • Represented a local bank in various commercial loans secured by agricultural assets.
  • Represented a Tennessee state bank on a $17 million term loan secured by payment-in-lieu-of-tax encumbered real estate.

  • Real Estate and Economic Development

  • Represented a rural industrial development board in the award of state and local economic development incentives as part of a $25 million project that included PILOT, Grant and New Market Tax Credit awards.

  • Assisted a global athletic footwear company with the leasing and construction aspects of a 500,000 sq. ft. warehouse expansion.

  • Assisted a global “big box” retailer as to incentive, jurisdictional, and real estate issues associated with a $45 million construction project.

  • Assisted a medical device manufacturer in the real estate and economic incentive portions of a $290 million sale and headquarters relocation.
  • Represented a global conveyor company in all aspects of economic development, leasing, and construction of a $15 million consolidated manufacturing facility in Arkansas.
