Brent Cole concentrates his practice in transportation litigation, insurance coverage analysis and litigation, premises liability and negligent security defense, and various other types of liability defense and litigation.

Professional Biography


Brent represents businesses and individuals in a wide variety of types of liability defense and litigation, including trucking/transportation, premises liability and negligent security, products liability, and contract disputes. He also represents various insurance carriers, intermediaries, and agents in coverage analysis and litigation matters, including bad faith and negligent procurement claims. Brent is a member of the Firm's 24-Hour Motor Carrier Emergency Response Team, a group of attorneys providing rapid post-accident response, coordination, intervention, and investigation, whenever and wherever our clients find their vehicles in an accident.

Brent's experience includes defense of parens patriae and multi-district, class action and mass action litigation, regarding foreign and domestic price-fixing claims, insurance products and sales schemes, and products liability related to a number of pharmaceuticals, medical devices, and automobile products.

Prior to attending law school, Brent worked as a commercial insurance underwriter and broker in the excess and surplus lines market.

  • Handled investigation and defense of hundreds of transportation cases of all types involving numerous types of commercial equipment, including tractor-trailers, box/straight trucks, passenger vehicles, and mobile equipment.

  • Conducted investigation and defense of various bad faith claims against insurance carriers and intermediaries related to property, casualty, inland marine, and professional liability claims handling.

  • Obtained numerous favorable settlements for motor carriers and drivers in matters involving fatalities, serious injuries, alleged failure to properly maintain carrier's commercial vehicles, and multiple alleged violations of Federal Motor Carrier Safety Regulations (FMCSRs).

  • Secured numerous summary judgment awards regarding insurance coverage disputes for insurance carriers.

  • Achieved dismissal of claims against an insurance agent for negligent procurement of insurance coverage involving the Federal Motor Carrier Safety Act.

  • Achieved dismissal of claims against a retailer for products liability claims related to alleged faulty electronic handheld devices.

  • Obtained summary judgment in favor of a lender in litigation alleging fraud and violations of state statutes.

  • Appealed and secured dismissal of violations and civil penalties assessed by the Federal Motor Carrier Safety Administration.
