Although she has successfully resolved many cases through pre-trial motions and negotiations, she is an experienced trial attorney. On many occasions, Ashley has been asked to step in on cases shortly before trial, and her detail-oriented and strategic approach has helped achieve countless favorable results for her clients.

Ashley regularly:

  • Defends hospitals, behavioral health facilities, medical groups, skilled nursing facilities, and long-term care facilities in medical malpractice and related claims throughout Louisiana.
  • Counsels hospitals and physician leaders throughout the spectrum of medical staff matters that include credentialing and privileging issues, the peer review process, and quality improvement.
  • Represents clients before various licensing agencies, including the Louisiana State Board of Medical Examiners, Louisiana Board of Nursing, and Louisiana Department of Health.
  • Provides crisis management support and advises her clients about issues that arise in the day-to-day operations of health care facilities and compliance with health care regulations.
  • Works closely with in-house counsel and risk managers of a major regional health system and provides health care regulatory and compliance counseling.
  • Provides strategic input on risk mitigation/management efforts and advises her clients in complex care situations involving pregnancies, psychiatric patients, pediatric patients, and dealings with government officials and law enforcement, among many other matters.

  • Represented physicians and health care providers in more than 400 administrative and judicial proceedings in a wide range of medical specialties.

  • Tried numerous medical malpractice cases and successfully represented clients on appeal before the Louisiana Supreme Court and the Louisiana First, Fourth, and Fifth Circuits.

  • Assisted in drafting a HIPAA policy, procedure manual, and patient disclosure statements for a national health care provider.

  • Collaborated with client management to determine contract operations; developed and drafted procedures and forms for contract management from proposal development through contract closeout.
  • Represented continuing care retirement providers and nursing homes in litigation, transactional, and regulatory matters.

  • Successfully obtained dismissal on summary judgment of a multi-million-dollar lawsuit brought against a leading developer of spine surgery technology.

  • Obtained a favorable outcome for a health care client in a complex peer review proceeding, which involved a two-week jury trial.

  • Successfully defeated a plaintiff's attempt to circumvent the statutory cap on damages under the Louisiana Medical Malpractice Act through motion and appellate practice, including writs to the Louisiana Supreme Court.

  • Noteworthy Gaming Law Experience

  • Advised and counseled the Louisiana Gaming Control Board and the Louisiana State Police on legal matters and other issues impacting the regulation of gaming in Louisiana.

  • Reviewed and processed recommendations made by the Louisiana State Police to the Louisiana Gaming Control Board regarding licensing applications, transfers of ownership, and suitability.

  • Advised the Louisiana Gaming Control Board, its chairman, and the Louisiana State Police in a wide range of gaming regulatory, licensing, and administrative matters pertaining to riverboat gaming, land-based gaming, and video poker.

  • Successfully represented the Louisiana Gaming Control Board in various litigation matters, including matters before the First Circuit Court of Appeal, and provided key strategic advice and guidance to the Gaming Control Board relative to decisions pertaining to appeals and settlements with licensees.
