Rodney G. Moore is a shareholder in the Firm's Atlanta office and a member of the Business Litigation Group. Mr. Moore represents clients in labor and employment, business litigation and mortgage-related litigation matters. An experienced litigator, Mr. Moore has tried cases to verdict both in federal and state courts and has conducted over 75 judicial and labor arbitrations. Mr. Moore is rated "AV" Preeminent by Martindale-Hubbell and has been listed in The Best Lawyers in America since 2007. In 2012, he was selected as a Georgia Super Lawyer by Super Lawyers magazine. In 2008, he was selected by The National Journal as one of the "50 Most Influential Minority Attorneys in America."

As a business litigator, Mr. Moore has represented Fortune 500 companies and public agencies in major litigation, including class actions alleging unfair business practices and constitutional violations. As part of Mr. Moore's labor and employment practice, he assists management throughout the United States in responding to claims in all areas of employment law, including harassment and discrimination; overtime and other wage and hour claims brought under the Fair Labor Standards Act and similar state statutes; the Family and Medical Leave Act (FMLA); restrictive covenant and trade secrets; whistleblower matters; and public/governmental agency due process claims and hearings.

Representative Matters

  • Successfully arbitrated labor appeal finding just cause for termination of employee for workplace violence, including obtaining F.R.C.P. 12(b)(6) dismissal of employee's subsequent federal court lawsuit alleging violations of the National Labor Relations Act.
  • Litigated claim of Retaliation based on HIV status and utilization of FMLA leave (obtained Summary Judgment).
  • Litigated claim of liability based on sexual assault committed by employee (obtained Summary Judgment).
  • Defended overtime collective actions brought against employers under FLSA.
  • Advised on WARN Act Compliance, Notices and Facilitation.
  • Defended class action alleging race discrimination in the administration of insurance claims.
  • Defended class action alleging unconstitutional search and claim that class constituted third party beneficiaries. 
  • Successfully arbitrated labor appeal finding just cause for termination of long term employee for destruction of company property.
