Harriet Ivy, of counsel in the Birmingham office, has broad experience in the area of business litigation.  She concentrates her focus in areas of intellectual property litigation, particularly trademark, trade secret and copyright litigation.  She has also represented and counseled clients in the field of antitrust law. Ms. Ivy has extensive experience representing clients before appellate tribunals, having primary responsibility for briefing in appeals pending before the Alabama Supreme Court, Eleventh Circuit Court of Appeals and Sixth Circuit Court of Appeals. She has presented oral argument before the Alabama Supreme Court and Eleventh Circuit Court of Appeals.  Ms. Ivy has assisted clients and has obtained successful results in many complex litigation matters, including multi-district litigation and class actions.

Recent Representative Matters

  • Obtained successful results for client in lower federal court and in Sixth Circuit Court of Appeals with regard to a challenge brought under the Dormant Commerce Clause to Tennessee's regulatory framework for the distribution of alcoholic beverages.
  • Defeated a putative class representative's motion for class certification in a Federal Rule of Civil Procedure 23(b)(3) action brought against gaming industry client.
  • Obtained dismissal of suit alleging trade secret misappropriation against software company and received final judgment affirming the dismissal from the Eleventh Circuit Court of Appeals.
  • Obtained victory for client in appeal construing Alabama's lease recording statute.
