Hans Schmidt is a litigation associate in the Nashville office. Mr. Schmidt handles a variety of commercial and business litigation matters, including commercial lease disputes, breach of contract, unfair competition, trade secrets, and defense of banks and lenders in financial litigation. He also has experience in employment litigation, and has defended employers in cases under the ADA, the ADEA, Title VII and other federal and state statutes. Mr. Schmidt has advised clients on matters of state and federal employment law compliance.

Representative Matters

  • Negotiated favorable settlement of federal Fair Credit Reporting Act claim against national financial institution.
  • Obtained summary judgment for national consulting and engineering firm in wrongful death case involving claims of negligent design.
  • Received summary judgment in federal district court case brought by former employee who was fired for misconduct, but who claimed she had been terminated in retaliation for complaining of sexual harassment.
  • Successfully represented various clients in charges of discrimination brought by employees to the Equal Employment Opportunity Commission and achieved "no cause" determinations.
  • Negotiated favorable resolution of alleged municipal zoning and codes violations for small business owner.
  • Obtained summary judgment on breach of contract, conspiracy, and tortious interference counterclaims brought by commercial borrowers/guarantors against regional bank in state court litigation arising from the default of residential subdivision development loan.
  • Negotiated favorable settlement of litigation for manufacturer in breach of contract case under Article Two of the Uniform Commercial Code.
  • Prevailed on discovery motion compelling the use of specific search terms to identify and collect responsive electronically stored information of the defendant in multi-million dollar litigation involving federal and state claims for false advertising and unfair competition.
