Frederick Salvo, shareholder in the Jackson, Mississippi, office of Baker, Donelson, Bearman, Caldwell & Berkowitz, PC, concentrates his practice in commercial and insurance litigation. He regularly represents mortgage lenders and related financial institutions in a variety of litigation throughout Mississippi including the defense of statutory claims under the Truth in Lending Act (TILA), the Fair Credit Reporting Act (FCRA), the Fair Debt Collection Practices Act (FDCPA), the Real Estate Settlement Procedures Act (RESPA), the Mississippi Consumer Protection Act and the Mississippi Uniform Trade Secrets Act as well as common law claims of predatory lending, mortgage fraud, forgery, failure to procure insurance, misapplication of insurance proceeds and deceptive sales practices. He also has significant experience negotiating loan workout and modification agreements, short sales and in representing businesses in litigation involving the enforcement of non-compete and non-disclosure agreements and the protection of business assets and trade secrets. In addition, he regularly represents liability insurers in coverage matters and title insurers in defalcation matters and related regulatory, criminal and bankruptcy proceedings as well as claims handling. He also has experience representing manufacturing clients in personal injury and wrongful death disputes involving product liability and warranty claims.

Mr. Salvo clerked under Chief United States Magistrate Judge John M. Roper, Sr. from 2001 to 2002, completed an internship with United States Magistrate Judge S. Allan Alexander in 2000 and 2001, was Associate Notes and Comments Editor of the Mississippi Law Journal and served on the Moot Court Board.

Recent Representative Matters

  • Represented international facilities management firm in suit against former manager and competitor for violations of non-competition agreement and related claims for breach of fiduciary duties, duties of care and loyalty and unfair competition. Full enforcement of non-competition agreement and compensatory damages obtained.
  • Represent title insurer in claims against former agent and employee of former agent for misappropriation of escrow funds including claims for injunctive relief, sequestration of assets and breach of guaranty agreements as well as disposition of related title claims and criminal proceedings.
  • Represent title insurer in claims against former agent regarding defalcation including actions to locate, seize and/or sequester assets of the former agent for use as recoupment of claims paid by insurer as well as research and disposition of coverage disputes and title claims arising out of defalcation.
  • Obtained dismissal of mortgage fraud claims against mortgage lending and servicing firms in suits by homeowners regarding purchase of multiple residential properties.
  • Represented a telecommunications company in suit by consumer alleging violations of Fair Credit Reporting Act (FCRA). Nominal settlement obtained.
  • Obtained dismissal of claims by large number of plaintiffs against financial services firm alleging fraud and deceptive sales practices regarding sales of credit life insurance in connection with consumer loans.
  • Defended national mortgage lenders in suits by homeowners arising from Hurricane Katrina and alleging failure to notify of property's inclusion in federal flood zone and failure to procure flood insurance. Suits settled on favorable terms.
  • Successfully defended major automobile manufacturer in mass tort case filed by hundreds of plaintiffs alleging design defects in vehicle ignition systems. Vast majority of claims dismissed and remaining claims settled for nominal amounts.
  • Obtained temporary restraining order and preliminary injunction on behalf of publisher against former employee manager who attempted to create own business using proprietary information of publisher.
  • Represented property management firm in premises liability suit alleging inadequate security. Obtained summary judgment on behalf of client.
  • Resolved dispute between client manufacturing firm and seller of business regarding funds owed under earn out provisions of asset purchase agreement.
