Emily Landry, shareholder in the Memphis office and co-chair of the Memphis Recruiting Committee, concentrates her practice in litigation. Her experience includes products liability, medical malpractice, transportation, premises liability, insurance defense, class action, professional malpractice and general business litigation.

Ms. Landry has significant products liability experience, representing manufacturers, wholesalers, distributors and retailers of a wide variety of adult and child products in both pre-litigation claim resolution and litigated matters before state and federal courts in Tennessee, Texas, Arkansas and Florida. She has defended automobile manufacturers against allegations regarding seat belts, brakes, rear axle and roof crush. She has defended numerous drug and medical device manufacturers as well. Ms. Landry also substantially contributed to the approval of a nationwide product liability class action settlement, and has coordinated all aspects of post-judgment claim administration since the finalization of that settlement in 2005.

Ms. Landry's experience in medical malpractice is substantial, as is her medical peer review and credentialing process knowledge. She has successfully defended a local hospital system against multiple requests for information and documents protected from disclosure by the Tennessee Peer Review Law, and routinely represents physicians and hospitals in wrongful death and personal injury actions.

In the area of transportation litigation, Ms. Landry has successfully defended the interests of several motor carriers in third party personal injury claims.

Recent Representative Matters

  • Represented product manufacturer in successful resolution of multiple claims during critical phase of Consumer Product Safety Commission analysis of potential product recall.
  • Represented product packager in breach of contract action to recoup capital expenditure for equipment upgrade required by customer service agreement. Obtained summary judgment on behalf of manufacturer in case alleging fire caused by defective string lighting.
  • Obtained summary judgment one week prior to trial on behalf of foreign car manufacturer in significant injury case involving allegations that defective brakes caused co-defendant to run red light.
  • Obtained numerous summary judgments or voluntary dismissal in numerous medical malpractice cases including in representation of internal medicine physician, pediatric infectious disease physician, neurologist and local hospital system.
