David B. Hall, shareholder in the Birmingham office, is the leader of the Firm's Transportation Group and an active member of the Firm's Product Liability & Mass Tort Group. Mr. Hall concentrates his practice in civil litigation with an emphasis on personal injury, consumer fraud/warranty, business torts, commercial disputes, transportation, product liability and insurance litigation. He is admitted to practice in all state and federal courts in Alabama, as well as the Eleventh Circuit Court of Appeals.
Mr. Hall initiated and shares oversight of Baker Donelson's 24-Hour Motor Carrier Emergency Response Team, a group of attorneys dedicated to providing rapid post-accident intervention and investigation throughout the Firm's footprint and beyond, whenever and wherever needed. Mr. Hall is former chair of Baker Donelson's Motor Carrier Industry Service Team.

- Obtained dismissal of wrongful death claim arising out of off-road earth moving equipment accident.
- Obtained seven figure settlement of wrongful death claim on behalf of beneficiary clients.
- Obtained seven figure verdict against United States of America in Federal Tort Claims act case arising out of medical malpractice claim.
Transportation
- Handled numerous investigations of commercial motor vehicle fatality accidents.
- Represents numerous commercial motor carriers in personal injury, freight and commercial claims in Alabama and the Southeast.
- Obtained dismissal of wrongful death claim arising out of rear-end collision between commercial vehicles.
- Obtained dismissal of wrongful death claim arising out of multi-vehicle head-on collision.
- Defense verdict in multi-vehicle accident between client's commercial tractor and passenger vehicles.
- Obtained dismissal of wrongful death claim in Louisiana State court and recovered client's property damage. Claim arose out of collision between commercial motor vehicles.
- Obtained dismissal of 50-plus nation-wide antitrust class actions filed against LTL Commercial Motor Carrier. Plaintiffs' alleged client wrongfully conspired with other motor carriers in industry to set surcharge rates.
Product Liability/Mass Tort
- Represents various product manufacturers in product liability, mass tort, occupational exposure and warranty claims.
- Obtained dismissal of class arbitration claims brought against manufacturer of consumer products.
- Successfully prosecuted claims by steel tube manufacturer against chemical supply company for sale of rust inhibitor that failed to protect client's product.
- Successfully obtained dismissal of more than 400 plaintiffs' toxic exposure claims on behalf of product manufacturer.
Commercial Litigation
- Represents various clients in commercial disputes.
- Represents builders and developers in construction, fraud and warranty claims, as well as commercial disputes.
- Obtained summary dismissal of complaint alleging fraud and breach of contract arising out of asset purchase agreement between motor carriers.
- Successfully enforced first right of refusal in commercial contract to purchase real property.
- Successfully enforced first right of refusal clause in commercial lease contract and summary dismissal of counter claim.
- Obtained dismissal of express warranty claims brought by homeowner against home builder arising out of purchase of new home.
- Obtained dismissal of complaint against coal sales company by cement manufacturer for alleged breach of contract, breach of warranty and fraud in sale of coal that allegedly damaged kiln. Successfully prosecuted counter claim for breach of contract and attorneys fees.
Insurance – Breach of Contract, Bad Faith and ERISA
- Represents various commercial/general liability, and life, health and disability insurance carriers against fraud, bad faith, breach of contract and ERISA claims.
- Obtained dismissal of class action brought against dental insurance carrier.
- Obtained dismissal of various ERISA claims for life, health and disability insurance carriers.
Business Litigation
- Represents individuals and entities in business governance disputes.
- Obtained dismissal of limited partner derivative action brought against general partner.
