Craig Caesar is an experienced trial and appellate lawyer whose clients turn to him for assistance on a wide variety of complex business disputes and government investigations. As an attorney in our New Orleans office, Mr. Caesar represents regional and national clients in the health care, marine product manufacturing, telecommunications and financial services industries.
Mr. Caesar advises his clients on antitrust, corporate governance and trade regulation matters, advocating for them in state and federal litigation, and defending them against investigations by the Federal Trade Commission and Department of Justice when necessary.
Mr. Caesar acts as general counsel to three national credit data exchanges, and has been involved with them since each was formed. In this role, he oversees and delegates as needed the handling of all of the legal issues for each entity. These issues can include antitrust and compliance issues, tax matters and contracts, privacy and data security concerns, as well as others as they arise.
- Prevailed in an 11-year case on behalf of major marine products manufacturer involving 3 separate trials on federal and state law liability and damage issues and appeals in defense of Robinson-Patman.
- Unanimous en banc reversal in health care client's favor of federal appeals court decision interpreting "Parker v. Brown/State Action" doctrine under Sherman Act.
- Representation of national PPO in multiple litigation and arbitration matters involving provider/payor disputes.
- Defeated certification of nationwide class of patients and providers in health care network litigation.
- Qui tam litigation defense for health care clients.
- Representation of clients in grand jury and Federal Trade Commission antirust investigations.
- Successful defense against enforcement of implied obligations of "continuous operation" for worldwide retailing chain.
- Successful defense of national feed supplier in distribution litigation.
- Antitrust counseling of health care clients and trade associations.
- Obtained Department Of Justice Business Review approval of proposed clinic merger and of credit data exchange creation and expansion.
