Brandon Jolly concentrates his practice in the areas of personal injury, labor and employment, contract and property litigation. He has extensive experience with personal injury litigation, including medical negligence, long term care and product liability cases; labor and employment litigation, including Title VII and FLSA cases; representation of landowners in eminent domain proceedings; real estate disputes and complex commercial litigation. Mr. Jolly also represents clients in insurance bad faith, insurance coverage, legal malpractice and business tort litigation. He is an associate in the Jackson office of Baker Donelson, and is a member of the Firm's Advocacy Department.
Prior to joining the Firm, Mr. Jolly served as judicial clerk to the Honorable William H. Barbour Jr., Senior United States District Court Judge for the Southern District of Mississippi.
- Won decertification of conditionally certified class of more than 1300 plaintiffs on behalf of large poultry processor in FLSA donning and doffing lawsuit.
- Successfully arbitrated numerous Title VII employment discrimination, harassment and retaliation cases on behalf of large employer.
- Obtained summary judgment on behalf of real estate investment firm in lawsuit against Internal Revenue Service in dispute over lien priority of multi-million dollar commercial properties. Mountaineer Investments, LLC v. United States, 2009 WL 3747205 (S.D.Miss. 2009)
- Successfully defended employer before the U.S. Court of Appeals for the Fifth Circuit in appeal of Title VII race discrimination claim.
- Actively representing employer in comprehensive wage and hour investigation by the United States Department of Labor.
- Obtained summary judgment on behalf of commercial real estate firm in landlord-tenant dispute. Westland Shopping Center, L.P. v. Chernin's Shoe Outlet, LLC, 2007 WL 4116104 (S.D. Miss. 2007)
- Represented Mississippi Governor Haley Barbour before Mississippi Supreme Court by filing amicus curiae brief in response to constitutional attack of statutory non-economic damage caps.
